ebay purchase cancelled

Here's the situation:
I bid on several large genuine new SKF heim joints (cost new is at least $60 each) in an ebay auction that had no reserve and a starting price of about $20. Also sent the seller a best offer through the BO button which he didn't accept but sent a counteroffer for $200. Was to high for me so I just waited till the auction end an won the auction for $25.
A few minutes after the auction the seller cancelled the whole purchase without contacting me or any explanation. Asked him why he cancelled and he just said that he can only find one joint anymore and that he is sorry.

What would you do?
 
Yeah, pretty shady. Let Ebay know. He may have some history with them. Either way you will need to probably buy elsewhere.
 
You cant do anything as he has put in a reasonable reason to ebay all you can do is not accept the cancellation and he will pay the final value fee probably $7
 
Thanks guys! Legal situation seems to be that I can sue for release of withheld items or claim property damage (value of items minus purchase price)..
 
I'd think the lawyer fees would be way more than your $200 value. Sucks,but sounds like you chalk it up as a sucky deal and move to the next. It isn't like you sent him the $200 and then he never sent you goods. I've done a bunch on Ebay and once in awhile you get a sucky deal but it is what it is.
 
You have heard of buyers remorse" ? This sounds like a case of sellers remorse" , they did not get the price they expected by selling it auction style, so utilized one of the creative ways to cancel your order. Not very honest seller. I have felt that I have similar experience with an E bay purchase like you have. The way E bay works, not a thing you can do other than complain, but that will only make you feel better about it. Don't believe that you will even have the opportunity to leave feedback on the item. I certainly don't think you have any legal recourse. If they are giving you a full refund, take it and and move on.
 
Similar experiences twice within the last year or so. I was unable to get any resolution either. Both sellers claimed they couldn't find the item after the auction closed.
 
The seller made the fundamental mistake of not putting a reserve on his auction - probably because
that costs more for him to list it that way.
Now, you got excited thinking you just got the deal of the century and he HAS to sell it to you now, eh?
Legal precedent says your chances in court ain't good, based on what I've witnessed in the past.
(I used to participate on a voluntary group that helped buyers and sellers on eBay years ago).
Are those parts worth the time and expense of lawyering up to you?
I'd say probably not....
Choose your fights in this life. This one ain't worth it. Acknowledge and move on IMHO.
 
Been buying on eBay for about 11 years now. Never been burned and always pick from a seller with 99 percent feed back and history or I just walk on by. It's hard to deal with someone across the country when things go bad. I have been told several times that I paid to much for this or that, but, I get what I want. Those deals that are to good to be true are usually just that.
 
...so something like this happened the other day to me as well. I bought a variable DC power supply and sent payment, after it shipped the dude told me he sent the wrong one....and wanted additional payment for the upgrade. I waited to see what was sent and indeed it was a slightly better unit. I told him to stick it and kept the unit. Obviously the buy did not have the unit offered and tried to scam up the additional 50 bucks for the other.....
 
Guy had a 66 426 hood ornament put a $100 bid in, guy removed item 4 days before auction ended. Asked why, bought a 66 Hemi Belvedere with no ornament.
 
Neg him. Didnt honor the sale. Seems to be a on going thing on ebay. That or they shill bid there own stuff to drive up a price of a 10.00 part to way higher then get you on the high shipping fee to cover there final value bill.

.....totally agree. Always check the shipping fee.
 
Sent him a message and told him that I find it rather strange that he suddenly realized that he didn't have the items just after the auction ended.
Also explained the legal situation and suggested he should google it (seller is in Germany) followed by another suggestion to look real hard for the parts as it would be a shame if I have to involve my laywer.
Seller only has a feedback rating of 8.. I know it's not worth it but I'll try to scare him a bit and teach him a lesson. He already replied and said he'll try to get some more of the joints ;)

To be honest. Using that tactic would get you removed from ebay. Better just to neg, and move on to finding another. Ebay has a strange way of viewing messages that appear threatening.

If you have to go through that much trouble to get the part from him do you really still want it? He sounds like the type of jerk off to break the part or stick it up his *** before he sends it to you. Like the girl says, "let it go..."
 
Plus...You stated he is in Germany??? Well that could come into play. I am not suggesting that it is a clearly shady deal coming from there but I would be very leery especially with a trader score of "8." Now also, is the opposite transaction of selling from the USA. I have had great success when selling my parts. All overseas and Canadian transactions have gone through flawlessly because I value my own integrity when it comes to representing a part I am selling. Perhaps this chap, doesn't have this feeling. We will never know. But with the way things are in this World today, one can only imagine what scams and phony sales are taking place. People are desperate and will resort to any and all means of unscrupulous doings. My suggestion is to find them here in the USA. Ask @super-bee_ski about shipping fees. I posted an item (A100 seats) from ebay and and said something like "but the shipping :rolleyes:" sbski didn't look at shipping and bid on it, shipping fees were $900. Seller was persuade to reduce shipping. I felt bad that I didn't put the price of shipping, glad he worked it out.

Ethire things got better or folks just do not shop for car parts on there much these days.
