Sitting at a red light.....and.....CRASH...CRASH....ouch...

It was 8:52 AM this morning and I was sitting at a red light in Kilgore, TX and then.....CRASH....something slammed into the back of my car and had hit me so forcefully that it shoved me nose first into the back of the Chevy Tahoe in front of me.

I sit there for a second, processing what had just happened, slowly get out of the vehicle and immediately notice it was a white honda civic that had plowed into me, grille is shoved through his radiator as it pisses antifreeze onto the ground, his airbags deployed and he stumbles out of his car and starts stumbling with I didnt know you had stopped.

Cop shows up, and what do you know...the guy knows the cop on a first name basis and they start chit chatting about their wives and if they had been to so and so soccer game. Guy that hit me asks the cop if he is going to give him a citation and the cop says naw, im not gonna give you a ticket man. At this point, my whole body starts to ache and stiffen (Not sure if from the wreck or anger). Cop tells me I can pick up the report from the police station in 3 days. My car is still driveable so I drive myself to the ER to get checked out. All in all, I am good, doc says im going to be real sore in about 2 days.

Going to call the guys insurance company tomorrow. I better not have to pay a penny for this as I did nothing wrong...but I am worried since he didnt get a citation.

Your insurance won't go up and he's in the wrong. That is NOT no fault.
You can slam on the brakes and he's still wrong.
 
sorry to hear of your misfortune, i would file a complaint with the police or local attorney general's office regarding his lack of citation. there should be no favoritism.. that is abuse of authority and should not be tolerated.
 
well apparantlyl the cop viewed it as no fault as no tickets were given out, and they were obviously friends....
 
you might be sore for a couple days but i would keep an eye open for anything that might be long term down the road.soory to hear about the rear-ender but glad you were able to get out of the car by yourself.

Theres will not be a citation written for that accident unless he was texting or talking on his cell phone.He would have to be seen talking or texting for a ticket. It was an accident. He didn't purposely smash into your rear. But its NOT No Fault.

Ok got it now, I misunderstood what you had said previously. Any advice on what I should say to the insurance company in the morning?

You need to notify your insurance company and get a copy of the accident report over to them.Your insurance company will start the ball rolling with their insurance company. You dont do anything but speak to your insurance company. They do all the work. Thats what you pay them for. Your rates will not go up.
Its black and white .Rear end hits are always wrong.

I agree. And if I could add one more thing, if anyone from his insurance co. tries to contact you, refer them to YOUR insurance company and don't say another word.

Also, don't let his insurance company lead you to believe that your car has to go to their facility for inspection. Take your car to YOUR body shop and let the insurance adjuster go there to inspect it.
 
First thing you do, even while the other bloke is still dragging himself out of the wreck, is take photo's! Take photo's from every angle, take photo's of the cars, his licence, the road, the witnesses, the cops, everything!!!

If ever anyone tries to dispute something, you have an excellent record of what really happened.

In Ohio, he would be ticketed for "failure to maintain assured clear distance". The butthole who hit you deserved a ticket. He also caused the accident. Don't let his insurance company call you and put the blame on you. Refer them to your insurance company. Be aware that YOU may be responsible for damage to the vehicle in front of you, the idea (however wrong it is) being that you should have had enough distance between you and it to not come in contact with it when hit from behind. Law vary state to state, though. Good luck.

WOW, Glad your OK!, get hit in the back THERE at fault.. Here in Pa. thats the law unless it was changed...G-Luck buddy! Ron
 
That bites. Make sure you tell your insurance co. everything that transpired between the cop and guy that hit you. And it doesn't take 3 days to get an accident report. Sounds like the cop and his buddy are going to talk things over a beer. At least no one was seriously hurt, but man are you going to be sore in the morning.
 
Contacted my insurance this morning (USAA- Unites States Auto Association) and they stated that *I* have to contact the other drivers insurance and file a claim with them. Otherwise, if I file the claim with USAA I will have to pay the $500 deductible.
 
In that situation your insurance company would (should) go after his insurance co. for the damage + the deductable.

Get the police report and look it over before you do anything.
 
You may have to pay the 500 initially to your insurance company but then they may give that money back after they deal with the guy that hit you other insurance company...im not a expert in usa insurance---

Take a bath in Epson salts for your muscles and just be glad your not seriouslly injured...

This happened to me too, first car in a 3 car crash, I was in my Coronet, stopped, window fogged so i couldnt see behind me.

Bang, I get out, there are two cars sitting there. A Honda had been pushed into me by a Nissan pickup.

Honda person is insured by Gieco, Nissan truck guy, it wasnt his truck, and it wasnt insured.

Geico says they will pay my bodily injury, but not for my bumper. They say its not their problem if a car they insure is pushed into another vehicle by a third party, WTF i say. But a lawyer says this is true and was backed up by another lawyer.

So i am stuck, either telling my insurance co and having my rates go up, or just finding a bumper on my own, WTF!!!!!!!!!!!!!!!!!!!!

First, glad your ok. Wait, I think your neck is getting sore,,,yes, I think it IS getting sore..LOL I'm not the suing kind, but if that happened to me, I'd be making the cop and the other driver crap some bricks. Classic Whiplash.
 
If you were legally stationary and struck by another driver, the other driver is automatically at fault, at least in TX.

Some local police agencies actually forbid their officers from issuing class "C" traffic citations to persons involved in accidents that they did not personally witness. The cop might have simply been trying to act nice to the other driver, while not admitting that he actually couldn't write him. Just FYI - This is not the case with DPS (TX Highway Patrol); they generally issue tix on wrecks were there is someone at fault.

You have to remember, insurance company's in general suck. And now a days to get a lawyer first you have to get a lawyer to get a lawyer. We are another home/car for them is all.
