Had my car at a friends shop for work being done. While it was there it was broken into.
My headers and Accusump system were stolen from it and my insurance wont pay and his insuracne said they are not liable. So I end up being out 2300 and he fixed the window they broke to get into the car for free but didnt offer to pay or even compensate in labor for my loss. ??
Does that seem right?

And, your "Buds" Insurance should pay.
It was parked at his business, correct?

Im no "legal Eagle" but i would think he was covered for his customers.

What kind of non-insurance did he have that wouldn't be liable for theft?

Something doesn't smell right. You car and parts should be covered since it was at his shop. I would do somemore digging.
 
Sorry to hear it....Bad deal. I agree, something sounds fishy. My guess would be he's worried about his premium going up if he makes a claim. Good luck man.
 
take it from someone who has had this happen(on the buisness end)the only way his insurance wont pay is if he was storing the car there as a favor to you with no paperwork on the vehicle.if it was in the shop to have work done,then either he or the insurance must pay for what happened.been to small claims many times over stuff just like this.
 
He said he contacted them and they said they are not liable. That it should be covered by my car policy or homeowners.
Car policy says because they were not installed at the time they are not liable and the home owners isnt covering it either.
Progressive sucks rat turds. Dropping them today if I can. Going with one company for it all and I think its State Farm. They cover our house and said if the car insured under them the contents would have been covered. Progressive says that because it was car equiptment that was stolen but it was not attached they are not liable. I hate them all. I pay thousands in insurance and when I needed it ... wasnt there.
 
Didn't you have a similar thing happen a while back 99ss? Thought I remembered something else getting ganked from you a while back, or was that someone else?
 
he's supposed to be insured, check with your city prosecutor,or contact a legal rep.

Not much I can do about it. If I sue him then I lose a friend and its 180 miles from my house in a different state as well. Its nothing but one big hassle. I cant force him to pay. The car was there to have the engine removed sent out to be checked out then reinstalled. It took a very long time for the engine to get back to him and while it was in the shop yard/ parking lot it was broken into. This was last summer and he called and told me right away about the headers but he didnt know and I didnt about the Accusump system until this weekend when I got the car back finaly. So its an old wound re-opened with me and now I realize I am out another $900 on top of the $1550 for the polished SS headers.

I cant be his consciense but you can't get blood for a rock either
 
It's not right, but the law is on the business's side. We're not liable for anything like that here, BUT I can tell you REAL quick that Charles and Rodney would NOT have let you handle that loss alone. They would have offered something. It's not right to leave customers out in the cold like that.

Oh and it's not a requirement for a business to have insurance against theft of customers property. It's strictly at the discression of the business owner whether he wants to opt for that coverage.

To me, that is a big flashing warning that the shop either doesn't have insurance, or their insurance specifically excludes customer cars and parts. Most collector car insurance only covers your car when it is being driven by you or is stored in your locked garage. I'm not leaving my car overnight or longer at any shop that doesn't cover my car and have decent security. I can't afford the loss. JMHO

Yes this is part 2 of it. Car finally came home and I realized more than the headers are gone ... almost doubles the money lost

To me, that is a big flashing warning that the shop either doesn't have insurance, or their insurance specifically excludes customer cars and parts. Most collector car insurance only covers your car when it is being driven by you or is stored in your locked garage. I'm not leaving my car overnight or longer at any shop that doesn't cover my car and have decent security. I can't afford the loss. JMHO

It was in Snohomish at the time as well

He even charged me extra cause he had to rebuild the clutch slave :(
 
Hmmm. What else was missing? Or just your stuff? Seems fishy to have what you had stolen. I bet it was an inside job. They new exactly what they were going after. Just seems really suspicious.

Freaken' scumbag low-life thief's in the cities, nothen's safe anymore... POS State Farm ain't that great either, had them for 25+ years, when I was contracting allot, they are absolutely horrible when "actually having to pay off on anything", unless it's specifically spelled out in your contract, they will all say that, "it's not covered/insured"... read it very carefully or your in for a big freaken' let down again... good luck with your claim

Sorry this happened to you.

Most all insurance companies avoid their Responsibility whenever possible.
It's also possible that the business owner neglected to even contact their
insurance company due to fear of a rate increase.
These companies are great at taking your hard earned money but if you need them,
your're screwed.

If you have comprehensive in your coverage, your insurance company is liable.
