Man that sucks! Here in CA many of the undocumented workers do not have insurance as Meeps sarcastically implies - matter of fact a few years back here in the SF bay area I was in a leased BMW being driven by a co-worker when we were hit from behind by a van driven by what we found out were undocumented "visitors". We persuaded the 3 van occupants to remain there till the cops showed up, but they tried to pay us off not once but 3 times, finally upping the ante to $1000. We declined. Then they called a friend who showed up in their car ten minutes later and they proceeded to unload tons of items from the van (drugs? Weapons? Not sure). When the cops finally arrived 1 hr later, they interviewed them, then came back to us and politely informed us to just walk away and call our own insurance. Why we asked. The ANSWER: BECAUSE.THEY.ARE.UNDOCUMENTED.WORKERS.WITH.NO.LICENSE.AND.NO.INSURANCE. WTF!!!!???And to think that CA wants to give drivers licenses to "undocumented workers" to make roads safer. And I'm sure all of them will have insurance too. Man, this hit an run blows big time and I hope you get some satisfaction out of this mess.

The cops said they have been instructed in these situations not to call immigration and not to enforce any of the normal laws that us citizens must abide by. They let them go and we had no recourse.
(B) Whoever violates division (A) of this section is guilty of failure to stop after a nonpublic road accident, a misdemeanor of the first degree. If the violation results in serious physical harm to a person, failure to stop after a nonpublic road accident is a felony of the fifth degree. If the violation results in the death of a person, failure to stop after a nonpublic road accident is a felony of the third degree.
