You're wrong here and about the insurance. If it gets lost, you welch on the refund of full amount because the part was 500 and insurance was 100. You get smoked in small claims on that one as well. Build the cost into shipping, you're on the hook.

It's your responsibility until it is in the hands of the buyer. UCC code is not on your side and never will be. And the shipper leaving it on the doorstep is NOT delivered, no proof of transfer. That one is another loser unless a signature is required.

Have at it however you want. I won't belabor this anymore.

The carrier is the middle man to get the package from the seller to the buyer.....ownership changes when the package is delivered to a valid address....

For me it doesn’t matter. I would be calling fedex ASAP whether I am the buyer or seller....

The seller did his part, he packed it, shipped it and provided tracking...as one can see the package is touring the states.....So the carrier has not fulfilled their end.....

If it was me and I was waiting for the part. I would be one the phone blasting someone at fedex......I would also let the seller be aware so they are in the loop and ask them to contact as well....

The person that should be blasted and dragged through the mud is the carrier....

did he actually not insure the Full value...?
because if so,this is a fail on both members.

and seeing as cracked back seems to know all about the payouts?
ill ask him..
using this example,if he had insured for Full value,would he not have been paid full value?
 
The package isn't that "late" when you consider that it made it to Florida and then got sent on the wrong truck for a trip around the USA. I imagine it needs to be AWOL for more than a month before FEDx is gonna pay a claim... and the OP stated he didn't pay extra to have it insured, so if he didn't care then...........
 
i get that,and myself ive had people ask me to " just ship it the cheapest way you can "and i make them repeat the no insurance thing twice.
then i usually pay for the insurance myself and dont tell them.
thereby covering my asseth.

sure it comes out of my pocket,but id Rather pay then and have the insurance!
than have a situation like this happen later.
Esp with big ticket items.

I had a package delivered and they dropped it off and took a picture with the box at my door. Cant remember if it was fedX or not. But buyer made claim with Paypal and lied to seller? Sounds like he wanted cake and eat it too. Hope it all works out for both parties

Had that happen happen years ago. "Ship it as cheap as possible" he said. It was less than 50 bucks so I did and ended up he got free parts or it got lost but that taught me a lesson. Smaller stuff goes into one of those 'if it fits it ships' priority boxes and it gets insured for full value. So far so good.

If it's insured and lost, there is a waiting period that must be followed. It could take weeks to be paid on the claim. Damage is a whole other can of worms. Some are self insured and fight tooth and nail to deny claims. Once the claim is over a certain amount, there is usually an insurance company of some sort involved that can be a PIA... DAMHIK!!!! Getting a claim paid can be a difficult task.

And the ship it the cheapest possible... you better have that "I don't want it insured" in writing or you will lose on a loss/damage claim.

Yes the buyer can certainly call a shipper with a tracking number and rattle some cages. Claims, not a chance unless right are subrogated in writing from the shipper.

Taking a picture doesn't constitute valid delivery. The shipping company can complain all they want. Unless it is in a "secure" location, it's on them. Porch pirates steal stuff all the time because requiring a signature on deliveries was cut out of the process in an effort to deliver more packages. I had things stolen a few weeks ago. Happens all the time. IMO, there are crews that do nothing but follow delivery vehicles in neighborhood to bag stuff.

it sounds like a nightmare.

as far as in writing,thats exactly what i meant by i make them say it Twice,in emails or pms.
and then i Still insure it anyways...post#87

i noticed both the seller and the buyer have gotten very quiet and stopped answering questions.
fairly active thread too.....
heres hoping the package actually turns up and both parties manage to walk away somewhat intact.
 
My only beef in this argument is, I wish the GD delivery driver would ring the freakin doorbell or pound on the door so I know it's arrived! That is when I'm home.
