Speeding ticket

Got stopped a few weeks ago for doing 50 in a 40, cop wrote it for 50 in a 35. Technically, not guilty of speeding in a 35 zone because there is no 35mph zone on this road. Any chance of an ice cube in hell of getting this thrown out?

if the speed limit is wrong on the ticket it is cause for immediate dismissal.by technicality, if hes wrong on the speed zone he could be wrong on the speed.you'll need proof of how fast the speed limit is to beart it.

Did the ticket give a specific location of where the alledged crime took place?

If so, get a camcorder and video the entire portion of the road that you were on that day (including all speed limit signs) and have a discussion with the prosecutor.

Be very pleasant and show him the video.
Never hurts.

If that gets you nowhere, schedule it for court and show it to a judge.
They love video evidence....ask any perp that forgot about a dash cam and swung at a cop !!

The address of the 'infraction' is on the ticket. I can take some pics but don't have a video cam. Thing is, the speed on this road is 40 and has been for 30 years.

Snap shot of road sign and speed limit With even a cell phone should work, if its written right on the ticket would be good enough IF they check what its posted there. Laws vary from state to state but i agree with SSR on being grounds for immediate dismissible, should be the same as far as court goes.

If it were me i,d fight it...You have nothing to lose but time if you win and money and time if you lose...I know that the state of calif has a pic of every sign on all of it,s highways...The have a visual record all mapped out...Can you imagine whay iy cost to do that?

SSR has the right idea. Document everything! Pictures should do fine but somewhere I heard that you don't want to use digital because of how easy it is to photo shop the image. Get one of those disposable cameras and show them the Kodachromes rotest: If the cop doesn't show up you automatically win so make sure he has another court date somewhere else on that day! Sorry to say, but if you fight it and it gets quashed...fine. Unfortunately, he has 6 months to re-issue you another ticket that is filled in properly. You can always try - he or she might not be bothered to write you another one.

I fought the law and the law won, Podunk small town major speed trap cop pulled me over I was doing the posted speed limit said I had speeded earlier in posted area, that I had "pulled out like I had something to prove" whatever that means, I think he heard my dynomax mufflers saw a muscle car and thought I was a punk kid. I drove several miles back to said Podunk town to the court on the date the cop said to appear and he had given me the wrong date. Had to go back again, this time I give my story to the judge who asked if I wanted to plead to lesser charge of my speedometer being incorrect, I said no I wasn't speeding, judge heard cop tell his side, judge sided with cop I got the full price ticket and the point (higher insurance) I shook my head In disbelief asked if I could have the reduced fine (no points) he had offered me a few minutes ago judge said sorry that offer is no longer available.

To tell you the truth, don't really know but was running with the rest of the traffic and was surprised that I was getting stopped. When he stopped me, I had made a left turn on a green light and about the time I got up to speed, I saw him way back on a murdercycle. That road was 45 and I wasn't going over that so I asked what was up. He said that I was speeding on the road I turned off of but that was a over a mile back. I have a pretty good sense of speed and generally don't speed and usually keep myself in check since they are out there in force and looking for income and don't want to give them mine! On my way back, I found where they were set up and it was a good 2 miles from that point to where one of them stopped me. Even if I was going 50 in a 40, it still took the guy way to long to catch up....

Judge will side with the cop, especially if you were in precinct 4... Ask for jury trial. Use the system.

When my sons buddy told me this, i had a hard time believing it knowing the Ohio and Pa cops all to well, But i live on the Pa/Ohio line and the local closest Autozone is about 15 miles north headed for lake Erie, you can see it going up road, He was going up there for parts and got a speeding ticket, when it went to court and the judge asked Kenny what happened, he said he was headin for AZ to get a speedometer cable as his was broken (headed to AZ the truth anyway), he said he was trying to follow the traffic at there speed to keep from going over the limit, the judge ruled in Kenny's favor.

Ive seen these kind ticket challenges lose before. The judge will probably take the position that going 50 in a 40 is still speeding and find you guilty.

Whatever you do, if you go to court, dont tell the judge you 'might' have been going 50. Tell him you dont believe you were speeding, and were not moving faster then surrounding traffic. Suggest the officer got the limit wrong and mabye pulled the wrong car over. Its still a longshot IMO.

Most courts you must meet with an assistant DA,they often let you "plea bargin" the ticket to a no points ticket.It's all about the revenue for the overpaid judges:disgust: Otherwise when you plead not guilty and ask for jury trial,the court gives a new date so you have to waste 2 days or more to dispose of the case.My time is too valueable to waste,pay the reduced charge and GTF outta there:blob1:
