Construction of a fence is the number one method to avoid someone claiming adverse possession, a rather messy area of real estate law.
Why in hell would someone build their residence that close to the line....with all that land and view?
That's funny! Had a neighbor across the street that let his dog crap right in front of my mailbox and I said something to him expecting a smart arse reply and got it....he said it's good fertilizer and I replied that I'm about to start fertilizing your driveway. It didn't stop so I started carrying my shovel every time to the mail box and threw the poop in his driveway. He said something about it days later and just said to him to be glad it wasn't coming through his windows. No more poop from there on.The perfect naughty neighbor accessory:

Well, this thread isn't about working on the cars.....Didn’t work on my car, but I did work on my sons truck. It’s a 1986 W150 that had been off the road for the last 12 years. He’s been driving it for a couple months, and things are starting to show up from its extended nap. The big thing lately is that the heat didn’t blow hot. Changed the thermostat, back flushed the whole system, changed the oil, plugs, wires, cap and rotor. It’s running smooth, and the heat is back on, just in time for the cold weather.
My reward? One more nice day to unwind in the RR, and take a little drive. Job well done, and just reward!

That’s a good question. My guess is that the original owner either didn’t know where the property line was or didn’t care. Building applications were not as strictly scrutinized 40+ years ago than they are today.

Prescriptive easement is the area of law that I couldn't remember when I posted on this and is what could possibly come into play. Adverse possession and prescriptive easement are similar but are treated very differently in the courts. A successful adverse possession case can result in title changing hands. Prescriptive easement is when one party has open and notorious use of another's property without their permission for a period of time ranging from 2-20 years as specified by your state law (10 years in Washington). After that time period, you may not be able to stop the use. I attempted to use this on a property I bought to develop that was supposed to be 10.05 acres and was zoned for 2-acre lots. When I surveyed it, it came out to 9.65 acres, reducing the number of allowable lots from 5 to 4, a 20% decrease. One property line was about 1,000 feet long and was defined by an ancient barbed-wire fence that zigged a bit using various trees and tree branches stuck in the ground for support. It was outside my survey line, and would give me the 5th lot, so I approached the timber company that owned the adjacent property and asked if they would agree to that as the property line through prescriptive easement. They flat out denied my request and made it clear they were prepared to litigate if I pursued it. My attorney explained that the outcome of a suit was unpredictable and that it would be expensive. They had deep pockets, I didn't. Game over and I proceeded with a 4 lot subdivision. I had recent history with this timber company on another purchase of a 96 acre tree farm that had no legal access due to the county abandoning the last 1,065 feet of the road accessing it, which was on the same timber company's land. Because it was considered county road up until the property owner decided to sell, there were no easements in place for ingress/egress. They committed in writing to provide me the necessary easement at an agreed upon price, then wrote an unworkable contract. When we sat down to negotiate 43 points of contention, they bullied me into buying the road. Their attorney and I didn't much care for each other after that meeting.
If you pour some bacon grease on it, the dog will come back and clean it up for you.
Besides having the property surveyed twice since we've owned it, checking the online town property maps (with dimensions), the property line shows exactly where it is has been surveyed and it is that close to their building. The building regulations say that buildings cannot be any closer than 10' to the property line & their building is about 8-9'. They also have a wood shed that's only 2-3' off the line. If they start squawking, I've got that as ammo.

I do fence work and did some for a friend who had a fence business… Some are nice easy jobs and others were a disaster. Some townships are good side out others can be good side in… Others can be on the line while others have a set back. Actually had one guy call the cops cause when we drilled the posts in there was “dirt” around the posts instead of grass. He wanted us arrested for property damage. Cop basically looked at the job and said we were just doing our job and left. So after each hole drilled he kicked the soil back in the hole off his side… There were some other insane issues but man people sure can be ********. I told that guy when we left I could see why he wanted solid privacy fence.Last fall, I put this up, but when the snow melted, it was gone.
